February 23, 2021 - En Banc Oral Argument at Eleventh Circuit Court of Appeals

February 23, 2021 the Eleventh Circuit Court of Appeals heard Mr. Kent's client former Congresswoman Corrine Brown's appeal en banc in United States v. Corrine Brown. Former Solicitor General Paul Clement joined the case pro bono for the oral argument. The single issue on appeal was whether the district court reversibly erred in discharging a deliberating juror over defense objection solely on the basis that the juror had prayed for guidance and felt that the Holy Spirit told him the defendant was not guilty - the trial court found this "disqualifying." This is a case of first impression in the federal courts and only one parallel case was found nationwide, a case before the Utah Supreme Court which permitted a juror to base his decision on a belief God had guided his decision after praying for guidance.
