February 11, 2021 - Eleventh Circuit Remands for Reconsideration of Sentence Based on First Step Act Argument

February 11, 2021 the federal Eleventh Circuit Court of Appeals in an appeal involving the First Step Act and the district court's discretion to reduce a sentence below the amended or modified guideline range issued a 13 page opinion for Mr. Kent's client Elijah Chisolm agreeing with Mr. Kent's argument that the district court's order was ambiguous whether the district court understood it had the discretion to reduce the sentence below the modified guideline range. The case was remanded for reconsideration by the district court.
